Embryo donation is currently prohibited in Switzerland under the Federal Act on Medically Assisted Reproduction (FMedG). Surplus embryos from IVF treatments can only be destroyed or donated for stem cell research, as per the genetic parents’ wishes.
Doctors who violate this prohibition may face fines of up to 100,000 Swiss francs. While reforms are being considered to potentially legalize egg donation and broaden access to sperm donation for both married and unmarried couples, the ban on embryo donation is expected to remain in place, as confirmed by the Swiss Federal Council.
Because embryo donation is not permitted, regulations concerning consent, anonymity, and recipient eligibility are not relevant in Switzerland. However, sperm donation is allowed, and donors are not anonymous; children conceived through sperm donation generally have the right to request information about their biological father after the age of 18, while donors have no legal rights or obligations towards the child.
